Introduction to the Terms of Use Agreement:
Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all legal consequences arising from your use of the store"s online services via this electronic platform. Any person"s use of the Nada Arts Store, whether as a consumer of a service, product, or otherwise, constitutes their full legal and legal consent and acceptance of all the provisions and terms of this agreement, and is a confirmation of your commitment to its regulations and to what is stated therein. 1. "Store" means the Nada Arts Store. This definition includes all forms of the Nada Arts Store on the Internet, whether an electronic application or a page on any social media platform.
2. "User" means any consumer who purchases a product or service from the Store via its electronic platform.
3. "Agreement" means the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.
Article Two - User Legal Capacity:
1. The User acknowledges that he or she has the legal capacity recognized by Sharia and law to deal with the Store or that he or she is at least eighteen years old.
2. The User agrees that if he or she violates this Article, he or she will bear the consequences of such violation before third parties.
Article Three - Nature of Nada Art Store"s Obligation:
1. Nada Art Store"s obligation to consumers or users is to provide the (service or product).
2. Nada Art Store may provide other services, such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the user.
Article Four - Controls for Use of Nada Art Store:
1. The user is obligated to use Nada Art Store"s electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2. When purchasing a service or product from Nada Art Store, the user is obligated not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.
Article Five - Accounts and Registration Obligations:
Upon applying to join Nada Art Store as a user, you are obligated to disclose information for use when accessing Nada Art Store"s services. By doing so, you agree to:
1. Nada Art Store is responsible for maintaining the confidentiality of your account information, and you agree to immediately notify Nada Art Store of any unauthorized use of your account information at Nada Art Store or any other breach of your confidential information.
2. Nada Art Store will not be liable in any way for any loss you may suffer, directly or indirectly, morally or financially, as a result of the disclosure of your account information.
3. You agree to use your account or membership at Nada Art Store yourself, as you are fully responsible for it. If someone else uses it, you will bear the consequences of any losses or misuse, as you have authorized them to use the store in your name and on your behalf.
4. You agree to use Nada Art Store with all seriousness and credibility when using Nada Art Store.
5. You agree to provide true, correct, current, complete, and legal information about yourself as required during registration with Nada Art Store, and you agree to update your information if it changes or if necessary.
6. Nada Art Store is committed to treating your personal information and contact details with the utmost confidentiality.
7. If Nada Art Store discovers that you have disclosed information that is untrue, incorrect, outdated, incomplete, illegal, or in violation of the Terms of Use, Nada Art Store has the right to suspend, freeze, or cancel your membership and account on the platform, without prejudice to Nada Art Store"s other rights and legitimate means of reclaiming its rights and protecting other users.
8. In the event of failure to comply with any of the above, Nada Art Store management has the right to suspend or cancel your store or membership, or block you from accessing Nada Art Store services again.
Article Six - Electronic Communications and Official Means of Communication:
1. The parties to this agreement agree that communication shall be conducted via the email or WhatsApp registered on the platform, telephone number, or via social media platforms.
2. The user agrees that all data and communications provided electronically are equivalent to their written counterparts and are sufficient evidence to meet regulatory and legal requirements.
3. The user agrees to the possibility of communicating with him and informing him of any provisions related to this agreement or related to dealings with him
by the management of Nada Art Store broadcasting general messages to all users or to specific users of Nada Art Stor
Article Seven - Amendments to the Terms of Use and Fees:
1. Nada Art Store may notify you of any amendment to this Agreement in accordance with the official communication methods provided for herein.
2. If you object to any amendment to the Terms of Use, Nada Art Store hopes you will cease using its services. Your mere access to your Nada Art Store account or use of Nada Art Store constitutes your acceptance of the amendments and your full and complete consent, void of any misunderstanding. Nada Art Store accepts discussion of any proposal regarding these terms.
3. All fees are calculated in Saudi Riyals, and the user must pay all fees due on the platform, in addition to any additional expenses added by Nada Art Store. Payment must be made through the approved and specified means available through Nada Art Store.
4. Nada Art Store may charge some users fees, depending on the offers, products, or services they request, or the fees or taxes imposed by the state on the nature of the product or service. 5. Nada Art Store reserves the right to add, increase, decrease, or deduct any fees or expenses under the terms, clauses, and provisions of the User Agreement from any user, regardless of the reason for their registration.
Article Eight – Nada Art Store Payment Services:
1. Nada Art Store, through its partners, provides the Nada Art Store payment system. Payments can be made entirely online using the payment options available on Nada Art Store or through any payment method provided by Nada Art Store from time to time.
2. Nada Art Store is committed to setting the price of the service or product it offers in its store based on the recognized market value.
3. Nada Art Store is committed to providing invoices for all amounts and profits generated in its store and is committed to providing the user with an invoice for their purchase of a service or product from Nada Art Store.
4. Nada Art Store is committed to providing the recognized accounting specifications in its online store in accordance with the provisions of this agreement and the legal, economic, commercial, and regulatory interests of this organization.
Article Nine - Your Personal Information and Transaction Details:
1. The User acknowledges that he/she grants Nada Art Store an unlimited, worldwide, perpetual, irrevocable, royalty-free right and license to use any personal or other information or materials that you have provided or supplied to the Nada Art Platform or announced on the Platform by joining or using it, through the designated contact and registration forms, via any email, or any of the communication channels available on the Platform, for the purpose of achieving any interests deemed by the Platform.
2. The confidentiality of consumer information is subject to the rules of Nada Art Store"s "Privacy and Confidentiality Policy" and the provisions of this Agreement related to confidentiality.
Article Ten - Intellectual Property:
1. The intellectual property rights of Nada Art Store are fully owned by Nada Art Store, whether they were owned by them before or after the establishment of this electronic platform. 2. The user or consumer respects the intellectual property rights of Nada Art Store, including Nada Art Store itself and the words, logos, and other symbols of Nada Art Store or displayed on Nada Art Store, as Nada Art Store and any rights associated with Nada Art Store are fully owned by Nada Art Store.
Article Eleven - Nada Art Store Liability:
1. Nada Art Store is committed to conducting its business through this electronic platform in a regular manner and in accordance with the laws in force in the Kingdom of Saudi Arabia and the provisions of this agreement.
2. Nada Art Store is not liable for any claims arising from errors or negligence, whether caused directly, indirectly, incidentally, by the user or by a third party such as shipping companies.
3. Nada Art Store, its employees, owners, and representatives are committed to ensuring that the product or service is sound, legitimate, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.
Article Twelve - Confidentiality of Information:
1. Nada Art Store adopts measures (physical, organizational, and technical) to protect users and prevent unauthorized access to and storage of users" personal information.
2. You, as a user, acknowledge that the internet is not a completely secure medium, and the confidentiality of your personal information cannot be guaranteed 100% through Nada Art Store.
3. Nada Art Store has no control over the actions of any third party, such as other websites linked to the platform or third parties claiming to represent you or others.
4. You acknowledge and agree that Nada Art Store may use the information you provide to provide services to you at Nada Art Store and to send you marketing messages. Privacy at Nada Art Store governs the collection, processing, use, and transfer of your personal information. The confidentiality rules are subject to Nada Art Store"s "Privacy and Information Confidentiality Policy."
Article Thirteen - Restriction of Access or Membership:
Nada Arts Store may suspend or cancel a user"s membership or restrict a user"s access to the Platform Services at any time, without notice, for any reason, and without limitation.
Article Fourteen - Applicable Law or Regulation:
This User Agreement is governed by and formulated in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and is fully and entirely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.
Article Fifteen - General Provisions:
· If any provision or clause contained in this User Agreement is cancelled or if any provision or clause contained in this User Agreement is no longer valid, such a matter shall not invalidate the validity of the remaining provisions.
